Monday, February 6, 2012. For any of you with e-readers of some kind (insert unsolicited plug for B&N's Nook. Here), you should go peruse the archives at Project Gutenberg. And Sir Arthur Conan Doyle's The White Company. It also has, to my delight, a number of works by G.K. Chesterton. This gives me the opportunity to read Orthodoxy. And Eugenics and Other Evils. The latter piece starts with the following paragraph:. Links to this post. Subscribe to: Posts (Atom). I am Simon Jester.

Friday, January 11, 2013. WE NEED TO REGULATE CARS THE WAY WE REGULATE GUNS. I found this through a friend today and thought I should share. P. I keep hearing people say they want to regulate guns the way we regulate cars. They don't really mean that, of course. What they mean is they want to make it acceptable to find more ways to intrude on the right to keep and bear arms. I propose instead, we regulate cars the way we regulate guns. Let's start:. Additionally, the purchase of more than two cars in a g...

Musings: Affordable Care Act
http://perlucidus.blogspot.com/2012/06/affordable-care-act.html
Thursday, June 28, 2012. All that said, what do I think of the ACA? There is one exception: I can expect to make some money off of it. A new bureaucracy will lead to more business for lawyers willing to take on administrative law cases. Subscribe to: Post Comments (Atom). I am Simon Jester. View my complete profile. Monday, February 11, 2013. I've Said It Before. And I'm sure I'll say it again. Anti-corporate personhood movements show a supreme lack of understanding of the underpinnings of corporate law. Also, they show a lack of understanding of the reasoning behind Constitutional protections for the individual. I ran across this. Today I know it isn't new. I know it isn't news. It is, however, noteworthy. Links to this post. Subscribe to: Posts (Atom). I am Simon Jester. Ive Said It Before. View my complete profile.

Musings: September 2013

Tuesday, September 10, 2013. I know I'm a little late on the Syria post, given some of the recent news. That might diffuse the situation, but I think a word or two is still in order. First, should we take military action in Syria? No I'm not saying this from a "look at the polls" perspective, though the overwhelming distaste. This is not a case of enemy-of-my-enemy-is-my-friend. Second, how can those who supported the invasion of Iraq be against intervention in Syria? Easy, in Iraq there was a UN mandate...

Musings: July 2013

Saturday, July 20, 2013. I believe I have used before the words of Daniel Webster:. There are men, in all ages, who mean to exercise power usefully; but who mean to exercise it. They mean to govern well; but they mean to govern. They promise to be kind masters; but they mean to be masters. I decline to do so. When President Jefferson was first inaugurated, he said, "Sometimes it is said that man can not be trusted with the government of himself. Can he, then, be trusted with the government of others?

Monday, April 4, 2011. A Little Comparative Legal History. This afternoon I had the pleasure of attending talks by two German Academic Exchange Service (DAAD). Fellows. The first was a very engaging discussion about theories of criminal punishment and the use of preventative detention in the German penal system. The second was an historical perspective on the development of abortion law, with a comparison between the US development leading up to and surrounding Roe v. Wade. The speaker, Felix Lange.

Thursday, July 26, 2012. Alright, folks, it is getting into the home stretch of election time. That means I get angry at every political advertisement I see. There is a very simple reason for this problem. Almost every political campaign (and the arguments of the candidates' supporters) relies on heavy use of persuasive language. These efforts at persuasion invariably rely on logical fallacies. Why? But, as a public service, I want to run down some of the most common fallacies I see in politics. 4 Beggin...

http://perlucidus.blogspot.com/2011_10_01_archive.html
Monday, October 24, 2011. This has nothing to do with law, politics, or philosophical thought in any way. This is about movie protagonists. As some of you know, I enjoy really bad action movies, also other really bad movies in other genres. But, I had the time to (re)watch Man on Fire. The other day. It made me wonder: who are the movie protagonists I think would be the worst to have mad at me? So, in no particular order, here are my top five. John Creasy, Man on Fire. James Bond, Quantum of Solace.

Musings: Emailed Lobbying
http://perlucidus.blogspot.com/2012/03/emailed-lobbying.html
Monday, March 26, 2012. So, I was asked to comment on one of those chain email things about politics. The bold print is part of the legal changes proposed in the email. Everything else is my knee-jerk reaction fired off within a few minutes. Any errors in reasoning are mine and due to not thinking before I type. 1 No Tenure / No Pension. A Congressman/woman collects a salary while in office and receives no pay when they're out of office. Ok, this is doable, I actually like this one. But, no tenure? I wou...
